Full summary

This motion, introduced by four councilmembers in August 2021, targets non-compliant and unpermitted short-term rental properties in Los Angeles by establishing better enforcement tools and infrastructure. The core directives ask the Department of City Planning, City Attorney, and Los Angeles Housing Department to create a centralized digital monitoring and enforcement database, develop a publicly accessible online registry of home-sharing properties, and assess staffing needs for effective enforcement of the Home-Sharing Ordinance. After years of departmental reports and committee deliberation, the Council voted 12-0-3 on March 18, 2025 to re-adopt the motion. Among the directives that emerged from the December 2024 Housing and Homelessness Committee action were two significant requests now under active development: first, that the City Attorney report on how to hire and retain qualified paid hearing officers for the Administrative Citation Enforcement Program (ACE Program), which currently relies on seven unpaid volunteer hearing officers; and second, that the City Attorney draft a private right of action clause for the Home-Sharing Ordinance. In response, the City Attorney's Office submitted a report and draft ordinance in May 2026 addressing both directives. On hearing officers, the report describes a program strained by volume — short-term rental cases are described as requiring extensive staff time from scheduling through final order preparation — and recommends securing a budget for paid officers and additional support staff. On the private right of action, the draft ordinance would allow tenants or property owners within 1,000 feet of an alleged violating short-term rental host (defined as an "Aggrieved Neighbor") to sue hosts, operators, or hosting platforms directly. Before filing suit, an Aggrieved Neighbor must notify the City Attorney's Office and give it 60 to 65 days to decide whether to investigate, then notify the alleged violator and allow 15 days to cure the violation. If the City Attorney's Office fails to act within 120 days of stating its intent to investigate, the neighbor may proceed independently. Remedies available in court include injunctive relief, direct money damages, civil penalties up to $5,000 per violation, and attorney's fees for prevailing plaintiffs. The City itself is explicitly shielded from liability under the provision. The Planning and Land Use Management Committee held the City Attorney's report and draft ordinance in committee on May 12, 2026, meaning the private right of action language has not yet been acted on. The file remains pending in both PLUM and the Housing and Homelessness Committee and expires May 8, 2028.
