City Attorney Report: R20-0070; R22-0210Related Council file No. 23-1022 thru 23-1022-S9

Brief

The City Attorney initiated litigation to compel the LA Alliance to provide specific responses to homelessness, as authorized under Government Code Section 54956.9. The matter was handled in closed session and periodically brought before Council for instruction to legal counsel on litigation strategy. After roughly six years of oversight and discussion, Council adopted the item on May 5, 2026. The file remains related to Council File 23-1022 and its subsequent items.

Full summary

In February 2020, City Attorney Michael Feuer submitted a report requesting authorization to discuss in closed session a threat of litigation by the LA Alliance for Human Rights seeking to enjoin and compel the City's response to homelessness. The matter was authorized under Government Code Section 54956.9(d)(1), which permits closed-session discussions of pending or threatened litigation. From March 2020 through mid-2025, the City Council met repeatedly in closed session to discuss the case — formally titled LA Alliance for Human Rights, et al. v. City of Los Angeles, et al. — and to instruct the City Attorney and legal counsel on litigation strategy. These sessions occurred every few weeks to several months, with the North Westwood Neighborhood Council submitting Community Impact Statements in July and August 2025, signaling sustained neighborhood-level interest in the outcome. The matter reached a resolution in May 2026. On May 5, Councilmembers Marqueece Harris-Dawson (8th District) and Tim McOsker (15th District) introduced three motions, all adopted by Council forthwith, implementing the terms of a settlement agreement as detailed in a May 4, 2026 City Attorney report. The three actions taken were: approval of an amendment to the Settlement Agreement; approval of Nardello and Co. LLC as the independent monitor of the Settlement Agreement; and approval of attorney and intervenor fees totaling $2.2 million. The appointment of an independent monitor signals that the settlement carries ongoing compliance obligations, and the City will be subject to external oversight of its homelessness-related commitments under the agreement. The file is linked to Council File 23-1022 and related items, suggesting the settlement is connected to a broader set of coordinated homelessness policy proceedings. The file remains open, reflecting that the settlement monitoring period is ongoing.
