Oceans 11 RV Park, LLC filed suit against the City of Los Angeles seeking a court order compelling the issuance of building permits for an RV park at 23416 South President Avenue in Wilmington. The lawsuit, brought in Los Angeles Superior Court and later in federal court, alleged that the City violated the Housing Accountability Act and constitutional provisions on due process and takings by withholding permits. Councilmember Tim McOsker introduced the original motion in September 2024 to bring the case to the Council in closed session under litigation privilege. The trial court issued a ruling that significantly shaped the current dispute: it found that a Conditional Use Permit is not required for an RV park, that the City must issue permits to Oceans 11 on a ministerial basis because the project satisfies performance standards under Los Angeles Municipal Code Section 14.00A.7, but that the Housing Accountability Act does not apply to this type of project. The City is appealing that ruling, with the matter now before the California Court of Appeal under Case Nos. B350259 and B354451. The Council's handling of the case has included repeated closed-session discussions and at least one rejected settlement proposal. In October 2024, the Council voted to reject the City Attorney's initial settlement recommendation. In June 2025, the Council adopted a motion by McOsker and Councilmember Katy Yaroslavsky formally rejecting a subsequent settlement proposal and directing the City Attorney to continue litigating. The file also spawned parallel federal litigation, Case No. 2:25-CV-02758, which the Council addressed in additional closed-session instructions in December 2025. The most recent action, on June 24, 2026, authorized the City Attorney to retain Burke, Williams & Sorensen, LLP under a three-year outside counsel contract with an initial value of $160,000 to assist in the appellate defense. Funding of $160,000 is to be transferred from the Unappropriated Balance to the City Attorney's budget at the start of Fiscal Year 2026-27. The Council adopted this package 13-0-2, subject to reconsideration under Council Rule 51, and the matter awaits the Mayor's approval. The file remains open as the appellate litigation continues.
