SB 79, authored by State Senator Scott Wiener, allows certain residential developments near transit stations to be approved ministerially — without discretionary city review or public hearings — if they meet specific state criteria. This creates tension between state housing goals and local control over land use, infrastructure capacity, and neighborhood character. The Council response, adopted March 24, 2026, on a narrow 5-8-2 vote, directed the city to pursue a two-track strategy: implement SB 79 through a local code amendment while simultaneously seeking to delay its full effect through mechanisms the state law explicitly permits. The adopted motion — presented by Councilmembers Blumenfield and Yaroslavsky, and amended on the floor — instructs the Department of City Planning to proceed with what the Planning report calls Option 1: a CT (Commercial Transit) zone expansion across all 55 Opportunity Stations citywide. On the same day the motion passed, Council referred an additional instruction from an amending motion by Councilmembers Nazarian, Soto-Martinez, and Jurado to the Budget and Finance Committee. By mid-April, Budget and Finance had approved the City Administrative Officer's first recommendation and transmitted the file to the Planning and Land Use Management Committee alongside reports from the CAO and Department of City Planning.
